Hospital Liability: What to Do?

Questioner

Hello, My husband was admitted to hospital in Eindhoven last week. He was very sick. He had an ipad 4 and a samsung galaxy phone on his nightstand. When he put this on his bedside table he looked at the time (4:00 PM). At 16:30 he woke up again and his things were gone. Nurses helped search but in vain. I reported it via the internet. My question: can I hold the hospital liable for this? Thank you in advance for your answer

Lawyer

Usually, a hospital does not accept liability for damage or loss of personal belongings. Sometimes, there may be liability. It must then be demonstrated that the damage occurred through no fault of your husband. In this case, it is important to report the damage to the hospital with a legal letter. If you can provide me with additional information, I can already draw up that letter for your husband.

The hospital is not liable for the damage unless you can prove that one of the hospital employees took the items. The hospital did not act unlawfully towards your husband. In addition, according to a court ruling, it is unwise to take valuable items to a hospital, so the hospital cannot be held liable for that reason either.
