Liability of illegal workers: rights and obligations

An entrepreneur takes on a black worker, a serious accident occurs, can the black worker hold the entrepreneur liable?

I assume that the illegal worker is the employee who is paid without any payment of taxes and premiums. In that case, the normal employer liability applies. The entrepreneur is in principle responsible if the employer has failed in his duty of care to prevent damage.
