Dear reader, During the last reorganization, I was placed in a position that the organization considered suitable, but which, in my opinion, is a hollowed-out remnant of my previous position. I no longer have a challenge, goal or future perspective. I am not yet 40 years old. I have indicated that I want to follow a higher professional education. However, I am not allowed to work less than 32 hours in this position. I have asked whether I can be declared redundant in order to make a good start for a new future. I have been employed for 12 years now. They actually want me to simply resign. I do not agree with this. What can I do if a request for a reduction in working hours is not granted? Yours sincerely, RLawyer
Reduction of working hours is a legal right. Your employer must grant a request, with some exceptions. See for example http://www.rijksoverheid.nl/onderwerpen/arbeidsovereenkomst-en-cao/vraag-en-antwoord/kan-ik-meer-of-minder-gaan-werken.html. The Working Hours Adjustment Act does not apply to companies with fewer than 10 employees. Companies with fewer than 10 employees can make their own arrangements. You may then work less, but there may be conditions attached to this. Labor law is my specialty. Feel free to contact me directly without obligation if you cannot reach an agreement with your employer.Questioner
Dear reader, Combining my current job with a study is difficult due to educational requirements and repetitive training. What would be another option?Lawyer
Another solution is to look for another job or to terminate the contract by mutual consent through a settlement agreement. However, an employer does not necessarily have to cooperate with the latter. I cannot judge what the possibilities are and what is wise in your situation without more information from and therefore consultation with you. I specialize in labor law and dismissal law and would be happy to help you with this. Please feel free to contact me without obligation.Take the next step
