Legal questions about vacation days in case of takeover

Questioner

The company I work for will be taken over by a new owner on August 25. Now all vacation days, overtime and vacation money will be paid on the takeover date. For me this means that I do not have enough vacation days for my summer vacation (mid-September) and have to use days from the following year. The contract will be taken over. Is this allowed?

Lawyer

That is not allowed. If the contact is taken over, all obligations are also taken over. But I do not understand why you have to use vacation days from next year. If you now have sufficient vacation days and they are paid out, you can still use that money to take unpaid leave, then you do not have to use days from next year. In fact, it is the same, only now you receive the money for the vacation days in advance in one go and otherwise you continue to receive your salary during the vacation.
