Legal Assistance with Temporary Hours and Employment Law

Questioner

Have a contract of 26 hours per week, shop closes earlier now I have to hand in 2 hours per week of my spare hours while I am prepared to work the hours another day. Can an employer just make you hand in spare hours?

Lawyer

No, that is not allowed. Such minus hours are at the expense and risk of the employer.

Questioner

Is this also the case due to high personnel costs? Thanks for the response

Lawyer

Yes, that is no excuse for this. A more detailed explanation: perhaps the subject of flexi-hours, minus hours, overtime and the settlement thereof (e.g. with an annual system) is regulated in the collective labor agreement or employment contract. If this is not the case, the employer bears the risk if he lets an employee work too few hours. In that case, there is a right to the wages for these hours, whether they are worked or not. It is therefore best to protest against this and to claim in writing the working of these hours and the wages for this. I can help you with this if you want. Labor law is my specialty.
