Your rights as an on-call worker: minimum wage explanation
Questioner
I work in childcare and, after initially having a zero-hours contract for 6 months, I have now been given a zero-hours contract for one year. I often have to come and work for only 2 or 1.5 hours per shift and I get paid for these hours worked. A colleague flex worker told me that the employer is obliged to pay for at least 3 hours per call. How is this legally regulated?Lawyer
Your colleague is right. Every time a company calls in an on-call worker, that employee is entitled to at least 3 hours' pay. As an on-call worker, you will be paid at least 3 hours for 1 or 2 hours worked if you meet one of the following conditions: - You have a contract for less than 15 hours per week. And you have not made any agreements about your working hours. OR - You do not have a fixed agreement about the number of hours you work. For example, with a zero-hours contract. http://www.rijksoverheid.nl/topics/labors-agreement-en-cao/question-en-answer/ Krijg-ik-als-roepkracht-ook-loon-als-ik-maar-1-of-2-uur- have-worked.htmlTake the next step
