Changing your last name during a divorce? Discover your rights!
Questioner
My husband and I were in a (fighting) divorce. We were already living apart when the request was filed with the court. Before it was pronounced, my husband passed away suddenly. Because the divorce has not yet been pronounced, I am entitled to, among other things, ANW. I still bear his name now, which I don't really like. My question is; Can I change my last name to my maiden name and still be entitled to ANW?Lawyer
Your official name (birth or maiden name) has never changed due to marriage. You can simply start using it again. Change has no effect on your right to a benefit under the ANW. It is wise to inform the paying agency in writing (by registered mail) of your name change.
