Good morning, my question is the following: We have lent money to our neighbours behind us, it concerns an amount of (350 euros), we have put this loan on paper and both parties have signed for the return of the money at the end of May! On May 28th my husband sent the following message ; Tomorrow, since we didn't meet I propose the following: next Saturday (31-5-2014 end of the month) I want at least half of the borrowed amount back. The remaining amount the following Saturday. Bvd. However, I then received a phone call saying that this was not proper and that they did not have it. In good consultation, an agreement was reached to postpone the event. In the end, they came up with 125 euros of the entire amount. However, we want the borrowed money back, but even after asking several times, it has remained at 125 euros. On Sunday my neighbor was at our door again to borrow an extra 40 euros for her daughter's birthday and decided that whatever happened we would get an amount of 200 euros back last Wednesday 11-5-2014 and the rest the following week. Now the following last Wednesday they had no money (excuse enough in our opinion) this morning 12-5-2014 contacted the neighbors and asked how you were doing.. no response to the question, but within an hour at the door with 150 euros which should have been 200.. they told me that we were not fair and did not take anything into account.. what I find strange is that we lend them the money and I therefore think that they are at fault and not us.. after all they have to pay us back.. I would like to know what I can do now to get my remaining money back of 115 euros We are starting to get really annoyed about it and would like our money back Thank you in advance for your responseLawyer
Day, normally when money is borrowed and no agreements are made about repayment, the whole sum is immediately due. But they are your neighbours and I think a fight is not a good idea, why not propose an addendum in which a reasonable repayment term is stated because apparently they do not have the remaining amount anyway. So monthly repayments, if late, again immediately due with statutory interest because there is default.Questioner
Hello first of all thank you for the answer now one more question... In the meantime there has been no response from the neighbors about a payment arrangement.. Or rather they don't want to hear anything from us anymore.. As is understandable we want the money back but what and how can we do this now we don't know anything about it. Day, What you can do best is to summon your neighbors in writing that they have to adhere to the payment arrangement, if they do not do this then the amount is immediately due + statutory interest due to default and you will not hesitate to hand over the claim for collection to a lawyer or agency.
