Advice on collective labor agreements and study agreements
Questioner
I have a one-year contract that will not expire with my current employer for the time being, but I want to go to a new employer closer to home. (I now live 75 km from work) I now read in my collective labor agreement - collective labor agreement article 60 g (see below) that I have to pay for my training if I leave on my own initiative within 1 year. I have followed the necessary training this year, but I have no insight into the costs of this. I have never signed study agreements for both mandatory and voluntary training courses. My question now; if I leave, up to what amount can my old employer hold me responsible? And if I have not signed a study agreement, can they hold me responsible because I do not know in advance for what amounts these are? collective labor agreement; The employee must reimburse the employer for the costs of the compulsory training courses if the employment contract is terminated at his initiative within the period from the start of the training course to 1 year after obtaining the diploma. (Now for me it also concerns partly compulsory training/courses, but it concerns a certificate and not a diploma. Does this give me any rights?) Collective labor agreement voluntary training Individual agreements regarding voluntary training courses and associated costs must be recorded in a written study agreement. (This has never happened to me) My employment contract only refers to the collective labor agreement and only states that I have a 1-month notice period. I would like to receive further advice on this matter.Lawyer
The collective labor agreement applies and therefore you must repay the costs of the compulsory course(s), but not those of the voluntary course(s). Does the agreement state that you can cancel in the meantime? If it doesn't, you can't leave early. Labor law is my specialty and I am happy to help you with this.
