Veterinarian liability: who can help you?

Questioner

Good evening, I'm googling and end up here. We're at our wits end. We had a young, very healthy dog, a French Bulldog. After his castration he lost some urine when excited. Last Thursday we got pills from our vet named Enurace, 2 x 10mg a day. After the first pill he threw up, we thought he had eaten something wrong outside, he was also a bit lethargic. Friday evening after his 3rd pill he was so lethargic that he could not stand up, then we saw that his eyes were full of blood. We called the vet and they were able to come right away. My boyfriend had been to the vet and I looked at the leaflet on the internet at home because I thought that could be the cause, because they had not given it. And yes, many side effects and the worst... there were 50mg pills in the box. Our dog appeared to have had an overdose. The vet admits to the mistake and thinks it is really serious. They had written the correct dose on the box but someone put the wrong dose in. In the end we got the dog home blind but he thought it would go away after 4 days. That night was terrible. Dog was scared, saw nothing and kept vomiting. He was confused. Eventually he had a very severe attack. Werr to the vet because dog was now completely unresponsive but was still alive. Vet indicates that he had a TIA or bleeding and wants to try to patch him up with medication. We wonder with pain in our hearts whether it is useful because dog seemed to be in a coma. Terrible! What would he suffer from we thought... we had to call back in the morning to ask how he was doing. They indicated that they could no longer do anything for our friend and that we had to put him to sleep. In the end he was cremated last week. Of course the vet took care of these costs and the costs for the evening. Seems logical to me because this is a serious mistake. We have a 13-month-old child who is constantly looking for his buddy, we ourselves are also devastated with grief. We asked the vet what to do next, he indicated that this was the end of it, but in the end he had his insurance call us. They say that we have to hold the doctor liable and have to claim costs. We have no idea what to think about. It is not about the money but about the recognition and that we get what we are entitled to.

Lawyer

Day, It is very bad what happened, an accumulation of mistakes that are admitted. What you are entitled to is the value of your dog - minus the costs of (up)feeding and any consequential damages, such as having to schedule a workday off. There is no reason to award non-material damages, however unfair that may be. If you would like help with writing a claim, you may contact me directly.
