Legal Advice on Bicycle Plan and Wage Claim

Questioner

Hello, I bought a bike in March 2014 through my employer's bike plan. I gave up 30 hours for this. (This was deducted from my leave budget for 2012 and 2013) I still had those hours. Now the company went bankrupt in July 2014. Fortunately, it was restarted. I have now received a claim for wages, but it states that I have to pay back the amount of the bike. Apparently the contract has been terminated, and I have lost my hours and have to pay back the net amount of the entire bike. Is this common?

In your question you do not indicate from whom you received the wage claim application. I find it strange, if you had simply used up the leave hours, you would not have to pay them back now. However, the conditions for the agreement you had with your previous employer regarding the bicycle were already met before the bankruptcy, you paid with leave hours and the employer delivered the bicycle. The contract can therefore no longer be annulled or dissolved. I advise you not to agree to the refund.
