Hello I was recently awarded an early IVA benefit after 8 months of illness. My employer has to keep me employed for two years, during which time I build up vacation hours (does not stop after six months). My employer now wants me to take these hours and the hours I still had before the illness before the end of my employment, which automatically ends after two years. There are no more reintegration obligations and the illness is permanent, no chance of recovery. Is this allowed, but shouldn't these hours simply be paid out at the end of the employment contract, as there is no fault of one's own and no reintegration option?Lawyer
Your leave accrual continues, unless a possible collective labor agreement stipulates otherwise. You are also entitled to payment at the end of the employment. I understand that leave accrual continues, the question is, can the employer demand that I take these hours while I am sick? Or let the hours expire because they were not taken? This concerns the collective labor agreement for hospitalsLawyer
