Good afternoon, I received an incorrect pay slip from my previous employer for the month of August. I also only received the pay slip (together with the one for July) after I had requested it myself. Also, the periods on both pay slips were reversed: August was suddenly period 7.1 and July was period 8.1. I then asked my employer for new pay slips for both months, but I only received a revised version for the month of August, for which the number of hours worked and therefore the amount was incorrect. With the remark 'the hours are correct now, you will not receive a new pay slip for the reversed periods' I was sent away. The problem now is that the cumulatives at the bottom of each payslip are no longer correct, in my opinion, after the revision of the August payslip, which is therefore designated as period 7.1. This is because the July payslip with period 8.1 was drawn up before the revision of the August payslip period 7.1 and therefore based on the incorrect cumulatives of the first payslip for period 7.1. The cumulatives on my new payslip 7.1 have namely changed due to the extra hours that had to be added, but the cumulatives of 8.1 should then also have changed, in my opinion. And so I should now also receive a new payslip for period 8.1 with correct 'final cumulatives', especially since that is my last payslip with that employer. I have reported this to my employer, but I have not received any response. In previous emails it was said that the annual statement will be correct because the cumulatives would have automatically changed for period 8.1, but I do not understand why I cannot receive a revised payslip for that. Furthermore, the employer says that requesting a new payslip from his accountant costs him €15,- and that he can therefore not simply request new payslips. Seems like a bad deal between him and the accountant, but not a problem that I should suffer from. Do you have any idea how I can solve this and whether I am within my rights to ask for revised pay slips? I myself am becoming rather uncertain about whether what I am asking is really so unusual due to the disinterest and irritation I notice from my employer. Let your employer know in a registered letter that you are not satisfied with his response and that you still want a correct pay slip. Point out to the employer that, under Article 7:626 of the Dutch Civil Code, he is obliged to provide the employee with a written statement of the wage amount, the amounts of which it is composed and the amounts withheld from the wage amount each time the wage is paid in cash. Give the employer 114 days to still provide you with a correct payslip for the period in question at his expense. Finally, state in the letter that if the employer does not comply with your request, you will submit the case to the subdistrict court.Lawyer
