Legal assistance for car damage in Croatia

Dear Sir/Madam, I recently suffered damage to my car. That was on a paid parking lot in Croatia on our holiday resort. It went like this 'I was standing in front of the barriers, one half of which opens to the left and the other half opens to the right'. Apparently it is customary for the right barrier to remain closed. I did not notice that at all and then I drove past it with my car, resulting in a big scratch on the car. Now my question is, should barriers not be legally provided with a protective rubber at the end of the barrier? And whether I am then entitled to recover that.

In this case, Croatian law probably applies. But if Dutch law were applicable, you would not be able to recover the damage. There is no obligation to attach rubber to barriers. In addition, you are also expected to pay attention yourself. If it was not possible to drive through the barrier without damage, you should have stopped and asked to open the other barrier.
