Does your internship count towards your employment history?
Questioner
Does an internship period also count towards your employment history? Situation: June 2012-Dec 2012: internship, 6 months 2 days a week at employer X (the other 3 days I worked at employer Y) Jan 2013-Dec 2013: 12-month appointment with employer X. Jan 2014-Jun 2014: 6-month appointment with employer X July 2014-Dec 2014: 6 months appointment at employer X My temporary appointment at employer X expires in December. However, does my internship count towards my employment history and should I now have a permanent appointment? At that time I did not receive a salary, but I did receive an internship allowance. I work for the government.Lawyer
The chain provision does not apply to employment contracts entered into in connection with a work-based learning pathway (BBL), unless your collective labor agreement stipulates otherwise. But you don't seem to have had a BBL agreement. Legally speaking, the (non-BBL) internship agreement is a 'normal' agreement that, if the requirements of Section 7:610 paragraph 1 of the Dutch Civil Code are met, can be seen as an employment contract. So the question is whether that is the case, as a rule it is not. Internships are usually aimed at gaining experience as part of a training course, making interns more like students rather than employees who deliver productive work. You also did not receive any wages, which is also one of the requirements for an employment contract. And is there a collective labor agreement that allows more than 3 temporary contacts?
