Questioner

Ir/Madam, Following an escalation with my team manager, I was suspended at the end of July, with the intention of finding another suitable position for me. The cause of the escalation was twofold: I had been working in this department since the end of October, but the work was not what I had been promised and so below my level that it was so mind-numbing that I could not get any energy out of it. On the other hand, I had problems on my private life, and this combination led to the escalation. However, there is no suitable position among the internal vacancies, which is why my employer now wants to make a severance arrangement with me. I have been working for the company for 16 years and I am not really satisfied with this. What can I do about this?

You can object to the suspension and ask your employer to employ you in a suitable position. Apparently, the employer is aiming for a termination by mutual agreement. You can then negotiate with the employer about the conditions under which you leave voluntarily. The employer can also request a dismissal permit from the UWV or dissolution from the subdistrict court if you cannot reach an agreement. In these cases, you will always be given the opportunity to defend yourself against the dismissal. In any case, I advise you to seek expert help to assist you. I have extensive experience in the field of employment law and if you wish, you can contact me without obligation.
