Assistance with Overcrowding and Municipal Fines

Questioner

The municipality says that two families (parents, son with wife and three children) may not live at 1 address. Father gave permission in 2008. Municipality claims that son does not live there. because they claim daughter goes to primary school outside this municipality. Now they claim that the rule has changed with effect from 1 January 2014. The investigating officer gives the parents of the son 14 days to arrange it. if not then a fine of 360 euros plus son with wife and children will be issued. What is the best course of action?

Lawyer

In principle, the municipality may take measures to prevent overcrowding, even if the owner of the home agrees. The municipality may officially investigate whether the persons registered at a certain address in the BRP actually have their main residence there. If this is not the case, the municipality can remove the registration and impose an administrative fine. I assume that you have received a decision from the municipality. You then have six weeks to object to this. You may be eligible for subsidized legal aid.
