Legal Assistance with Divorce and Alimony

Questioner

Good afternoon, Hope I can find an answer to my urgent questions here. I would like to know to what extent a spouse is obliged to contribute to paying fixed costs as long as the divorce has not yet been finalized. And an application for supplementary assistance has been rejected because nothing has yet been arranged with a lawyer regarding finances. The man is no longer resident at the woman's address and has been deregistered. The woman's income is too low to be able to pay all the fixed costs herself. But according to the man, his lawyer said that he no longer had to contribute to this because we would now be living separately for a long time. This means that if these payments are stopped, the woman will incur debts. And in the long term, a woman with children will end up on the street. The man has accommodation with family, where he has to pay almost no financial expenses. What can be done about this..is he completely within his rights to do this? Thank you in advance.

If you are unable to provide for yourself and your children in full or in part, your ex-spouse must contribute to this. I recommend that you discuss this matter with your attorney (you will need one for the divorce) and ask him or her to issue an interim order regarding spousal support and child support. You are eligible for subsidized legal aid. You can contact one of the lawyers on this website, a legal aid shop or law shop in your area or Het Juridisch Loket (0900 8020) or: http://www.juridischloket.nl/Pages/default.asp
