My stepmother will unfortunately pass away soon. Her mother is still alive so we are left with the question of where my stepmother's share of the estate will go if she passes away before her mother. Will this share go to her daughter (my stepsister) or to her brother (my step-uncle)? Or will it go to my father because they are married? I would like to have an answer to this and any advice on what to do in such a situation. Yours sincerely, SB

If your stepmother is still married in community of property, the statutory division applies and the inheritance goes to your father as the surviving spouse. If your father dies in turn, the stepchildren will receive their mother's deferred inheritance and the children will receive their father's. The order of precedence is in principle: spouse and children, followed by parents, brothers and sisters.
