Inheritance law advice for your inheritance issues

Questioner

Here is the problem in brief. I am Dutch and live in Austria. It concerns an inheritance. On 7-10-2011 my mother died and disinherited my brother, i.e. he gets his duty share, this is indisputable. However, my father's inheritance, who died in 1992, has not yet been paid out. And the battle about this has been going on for 3 years. The notary has calculated our inheritance shares, my brother gets a total of approximately 58,000, but he now suddenly wants 65,000, including inheritance tax and if I do not agree to this he wants to take legal action. (He has broken off all contact with the family since 1977) I do have a lawyer here, but he is not familiar with Dutch law. My question now is, does he have a chance of winning this case and perhaps even getting more? Thank you in advance for your answer.

Your story is not complete enough to give a good answer. For example, it is important to know on what grounds your brother believes he is entitled to more money and what the exact circumstances are. I understand your story to be that the inheritance in the Netherlands is settled according to Dutch law. In that case, it seems to me that it would be best to hire a Dutch lawyer. If you want, I can put you in touch with a lawyer friend in Vienna who also speaks Dutch and studied in the Netherlands (but he is a lawyer according to Austrian law). If you want, please contact me.
