Liability for Neighborhood Activities - Legal Advice Center

Questioner

We are a neighborhood association with full legal capacity and organize a neighborhood activity for our members several times a year. During the last activity, despite our warnings to keep our distance, a child walked into a pan of boiling water. Fortunately, everything turned out well for the child, but the result was that we as a board ask ourselves the following: Can the board be held liable if a member sustains an injury during an activity?

Lawyer

Yes, that is conceivable. That will occur in particular if it is foreseeable that damage can occur, it is relatively easy to take precautions, and you then fail to do so. You would also do well to consider whether you could insure yourself against such liability.
