On December 14th I ordered a product from a webshop with a discount code of 50%. I found this discount code on a promotional site and expected it to be a Christmas promotion. The site also clearly states that there is a Christmas promotion. The original amount is 350 euros, after which 175 euros is deducted due to the discount code. + shipping costs this amounts to 205 euros. Immediately after ordering I received an order confirmation, an hour later a 'binding order confirmation' as stated in the email. And on December 16th I received the product and started using it. Later that day (December 16) I received an email from the company stating that it must be returned because the purchase was unlawful and the purchase is unilaterally terminated. The discount code was never supposed to be made public. What I couldn't know. Am I now obliged to return the product? Yours sincerely,Lawyer
No, a valid purchase has been made. The seller will have to recover the damages from the party that made the discount code public, whether or not lawfully. I recommend that you send the seller a certified letter with acknowledgement of receipt stating that a valid sales agreement has been reached. You therefore dispute the legal validity of the termination of this extrajudicial purchase agreement by the company. The seller's error, by using the discount code, cannot be held against you.
