Legal Help: Selling Items Without Consent

Questioner

My ex sold my stuff without permission, what can I do?

Lawyer

I assume that your property was in the home that your ex-partner now lives in. If that is the case, you have a problem - legally. Your ex-partner is then legally the 'holder' and is considered by law to be the owner. You will therefore have to prove that the items sold - whether or not unlawfully - are your property and also that you did not give permission for the sale. If you think you can do this, you can decide to file a report of alienation (criminal law) and join the criminal proceedings. You may also decide to sue your ex-partner civilly on the grounds of the tort. In that case, the assistance of a lawyer is advisable.

Questioner

I would like to thank you for the quick response. Yes, I have all the receipts for the stuff. In fact, I'm still paying off the stuff he just threw away. What happens when you report alienation and what happens when you take civil legal action? I ask this because I don't know much about this myself.
