Legal advice on discussions with employer
Questioner
I am in an improvement trajectory where my boss and someone from my department are present. I will have a final meeting next week and I have sent my boss an email stating that I am bringing someone with me. We have a new automation system that has stripped down my function to such an extent that I am suddenly no longer able to do my job properly. I have had several conversations where the report turned out differently than what was said in the conversation. They don't want to have the conversation with a 4th person present... IS THIS ALLOWED?Lawyer
There are no legal rules for conducting interviews with the employer. However, it is common for the employer to allow this. You can ask the reason why the employer does not allow this and indicate that it is very important to you that someone goes along. If the employer continues to refuse, I advise you to have the interview. In any case, make sure that you do not sign or promise anything without further legal advice.Questioner
Thank you for your response. The reason I want to bring someone with me to the meeting is because my boss wants to speak to the other board members before the meeting. His response to my email is literally..... ..... That my boss sees no reason to have anyone else present at the meeting than himself and a colleague from my department and myself of course. My boss therefore has no intention of allowing a fourth person (whoever) to attend the meeting.Lawyer
It is unfortunate that your employer does not want to cooperate. You can ask your employer in advance what the conversation is about so that you can prepare yourself. If he offers you a proposal, it is therefore important that you do not sign or promise anything and, if necessary, seek legal assistance. You can always contact me personally for this.Questioner
Thanks again for the quick response. I have already done what you advised me to do, but I did not receive an answer to this either. I will now only enter into the conversation and will not be tempted to make statements and will have everything that is discussed put in the email. Thanks again.Lawyer
That is indeed the best. You are welcome and good luck.Take the next step
