Legal assistance in labor disputes

Questioner

I have been ill and am back at work. I have followed a rehabilitation program and have come out stronger. The work I do is going away, my manager and personnel affairs say that there is no other work for me. An employment expert has also been there and has looked at everything. My manager and personnel affairs tell me that I now have to have an employment expert from the UWV come and I have to pay 100 euros. Can this or can this while there is other work in the company that I can do. I have an idea that they want me gone. The occupational health and safety doctor says that I have a bad back while I can do everything. I have had a hernia in the past. I have had a scan and the neurologist did not think it was necessary for me to be operated on. I am working full time but my life is being made miserable by my employer. What can I do and who can help me, because I do not want to lose my job?

If you are working full-time again, you will eventually have to be reported as fully recovered. An expert opinion is required if you do not agree with the company doctor's opinion. If you are not going to be reported as recovered while you think you can do everything again, you can first discuss this with the employer and company doctor. If they maintain their position, you can indeed request an expert opinion from the UWV. How long have you been ill? After two years of illness, an employer may dismiss an employee. For some employers, this may be a reason to keep the employee 'sick' for longer. I cannot judge whether this is the case for you, but it is important to keep an eye on this. If your position is made redundant, the employer will first have to look for other positions and cannot simply dismiss an employee.
