Compensation after dental injury?
Questioner
I have a question... Some time ago I broke my canine tooth by eating a meatball that had a piece of bone in it. I sent the packaging, receipt, piece of bone and the dentist's quote to the company in question (I need to have an implant placed with a crown). I was promised by email that they would pay the bill. Now the thing is that I have moved abroad and therefore cannot have the treatment carried out in the Netherlands, I have sent them an email saying that I would like them to deposit the amount into my account so that I can arrange a dentist myself. I was then told that they wanted an invoice from a Dutch dentist. Apart from the fact that I cannot pay for this treatment in advance (1800 euros) and therefore do not receive an invoice in advance from a dentist, they are forcing me to have the treatment carried out in the Netherlands. Am I within my rights to demand that they deposit the quote amount into my account and if so, within what period can I demand this? Thank you in advance!Lawyer
You are free to go abroad and have the crown placed there. However, you are required to mitigate damages. The obligation to mitigate damages means that if the costs abroad are much higher than in the Netherlands, and it is not a big problem for you to be treated in the Netherlands, this may be requested of you. The company then only has to pay the costs as if you were treated in the Netherlands. Because you have suffered personal injury, you are entitled to compensation for pain and suffering in addition to compensation for the costs. In addition, it is wise to have your file assessed by a dental advisor for future dental costs. A personal injury specialist can arrange this for you. I therefore advise you to engage a personal injury specialist. Because the costs of this legal assistance are also part of your damage, engaging a personal injury specialist is usually free of charge. I wish you much strength and if you would like to use my services, you can contact me directly.Lawyer
The amount of the damage must be demonstrated by you. You have done this with the quotation. On this basis, the damage must be compensated. You cannot be forced to be treated by a Dutch dentist. What is important is whether you have health insurance that covers the costs. You must then first contact your health insurance. Have you considered that crowns have a lifespan of 10 to 15 years. This means that in 10 to 15 years you will have another claim for damages. You can also claim compensation for pain and suffering. It is a good idea to hire an injury specialist for this. You can always contact us without obligation. We can then discuss the possibilities. We work for victims free of charge.Take the next step
