Legal assistance in case of disability

Questioner

I have shoulder complaints, I go to a physiotherapist and my GP, now my employer wanted me to go to the occupational health doctor. The employer made an appointment for this, according to them this was only possible if they reported me sick for 25%, which they did while I continue to work 100%. Is this allowed? They did this without informing me, is that possible?

Lawyer

If you are unable to work due to shoulder complaints, you must be reported sick for 100%. You will then go to the company doctor and he will determine to what extent (%) you can still work and report this back to your employer. They will then have to take your complaints into account by offering modified work.

Questioner

I have been to the company doctor in the meantime. I am allowed to continue working, but with an adjustment of 4 hours behind the machine and the rest of the time other work. There are also some problems there, if I have been behind the machine for a quarter of an hour less, I have to make it up another time, which is then too long. Is this allowed?

Lawyer

the company doctor indicates that you can work 4 hours behind the machine. Then the employer may require that you can handle this and make up for the time not worked, unless you can no longer do it. In that case I advise you to contact the company doctor again. If you wish, you can contact me directly and free of charge for consultation.
