Questioner

In exit mediation, with the employer, we reached an agreement, which does not feel good to me now... the employer has no finances. We were very much pressured to negotiate by the mediator...and now the mediator has sent a composition concept...I have not signed yet... Is this all legal.. If I don’t sign, can I go to the local court myself? To dissolve this?

Lawyer

The mediator is free to draw up a draft agreement, but you are not obliged to agree to it. If you reject the proposal, the employer can start a termination procedure. In extreme cases, you can also request termination from the court if the situation is untenable. Are you not satisfied with the compensation offered? In that case, it may be possible to negotiate without the intervention of the court. If you need help in this matter, you can contact me without obligation.
