Questioner

I work in a supermarket for which the VGL-CAO applies. I have had a permanent contract of 24 hours per period of 4 weeks for 6 years. Normally I work on Saturday evening and Sunday afternoon. Now the supermarket manager has decided not to let anyone over 18 work on Sundays from a financial perspective (100% surcharge applies on Sundays). Also, my boss wants to let the assistants work in shifts of maximum 4 hours the rest of the time because this benefits productivity and because then there is no need to pay for a coffee break. Since I study during the week, I am only available in the weekend. Previously, this was not a problem. Now that my boss wants me to work in short shifts and not on Sundays anymore (I am 22 years old), I do not meet my contract hours of an average of 6 hours per week. I know that my boss is obliged to let me work my contract hours. However, I have the following questions: - Can my boss require me to be available on certain days (Monday to Friday)? - Can I demand to work on Sundays or can my boss forbid me to work on Sundays? - Can my boss decide to let me work only 3 hours per week on Sundays because these are 100% overtime hours?

Lawyer

If you have a contract, your employer must adhere to this contract and cannot deviate from it unless otherwise stated in the COA. So whether or not he has work for you under a contract, he must simply pay for that number of hours.
