Extension and neighbour law: Get expert advice

Questioner

We want to place an extension at the front of our house. This is for the kitchen. Inquiries with the municipality show that according to the zoning plan there are possibilities within a certain dimension. Regarding horizontal depth, this is 1.5 meters according to the zoning plan. Our neighbors are not happy with this because they will then look at a blind wall from their kitchen window. I estimate the distance from the frame to the planned wall of the extension to be 50 cm. The neighbors argue with the points loss of view and loss of light incidence (also because the sunlight is now unfavorably for them) and ultimately loss of value of the house. However, as long as I stay within the zoning plan of the municipality, I do not see a problem with obtaining an environmental permit. Is there possibly an article in the neighbour law that my neighbours can appeal to?

Lawyer

Dear, Art. 5.50 section 4 BW, states that you may not erect a structure within 2 meters of the separation that will unreasonably hinder the neighbor. This article could therefore apply if you erect a wall 50 cm from the separation, as I understand from your question.
