Assistance with debt collection and payment problems
Questioner
I was able to make an appointment with the client via a collection agency by paying them in monthly installments. Now the collection agency wants me to do this via them. I want to pay directly to the client. The collection agency now indicates that the agreement of monthly installments will then expire. Is this possible? Can't the collection agency also recover their commission from the client? The reason I don't want to pay through the collection agency is because they keep coming up with incorrect calculations.Lawyer
The collection agency can indeed recover their commission from the creditor. But ultimately, the collection agency is now the party that collects the claim for the creditor and the agreements with this party are necessary. If the creditor and you can mutually agree on payment arrangements, another arrangement can still be made. But even in this case, you will also have to pay the collection costs. There is also the option to have the claim brought before the court and have an amount determined there, if the collection agency keeps coming up with the wrong amount.
