Tips for administration and account management
Questioner
My sister and I have been appointed as administrators/mentors of my sister's husband who is in a geriatric institution due to dementia and is legally incapacitated. My sister has a joint account with her husband, i.e. in both their names. Now the subdistrict court is asking to open a separate account for my brother-in-law. Fine, no problem, but my sister makes all payments for gas, electricity, water, taxes from this joint account and also pays all expenses for her husband. They have their own home that is mortgage-free. The question is what money transfers should actually take place on this separate account to be opened for my brother-in-law? I can imagine that above an amount of 1500 euros my sister has to ask the subdistrict court for approval, but does she then have to split all normal payments?Lawyer
Good evening, As administrators, you must render an account and statement every year. In that case, the separate bank account that the subdistrict court asks you to open will relate to facilitating the control of the account and statement. So the items that are mentioned on the account and statement (form can be downloaded from www.rechtspraak.nl) are also the items that are important for the payment transactions on the bank account to be opened. The cantonal courts have a separate department for guardianship/curatorship. It would be best if you went there to discuss with the staff of that department how you can best do that (with that bank account) in the case of your spouse/brother-in-law. If you get into a fight, you can call me. Good luck.Questioner
Thank you very much, I will download the document you mentioned and will definitely visit the department of guardianship and curatorship. Good tip, then it turns out that you are still inexperienced in the country of jurisprudence and that with a grandson called 'Justice'! Have a nice evening!Take the next step
