Compensation after wrongful detention
Questioner
I was wrongfully arrested by the police last year and put in jail. I was held for a total of three days. Last week I received a letter stating that the case has been dismissed. A friend of mine pointed out to me that I am now entitled to compensation. Does anyone know if this is correct and can anyone tell me how to apply for it? I don't have money for a lawyer.Lawyer
That is correct. The request for compensation must be submitted within, I believe, 3 months after the dismissal. I can submit this request on your behalf if you wish. In principle, there are no costs involved.Lawyer
The standard amount is 105 euros per night in a police cell for non-material damage. In special cases the judge deviates from this (for example if the case has been widely covered in the media). In addition, material damage can also be claimed, for example lost income. As a rule, the court awards a fixed amount for the legal costs of drawing up (and possibly explaining at the hearing) the petition, so that it costs you nothing.Questioner
