Blocking a driveway? Legal advice at Rechtswinkel.nl

Questioner

Is our driveway part of the public road and can residents just use it? For example, I normally have 2 cars on my driveway. Now I'm going on vacation and I'm leaving 1 car. Can someone just park their car on my driveway during my absence (even though no agreements have been made about this and they are not personally aware of our absence)? And is it forbidden to block a driveway with a car, even if it concerns your own driveway?

Lawyer

That depends on the situation, which is unknown to me. Assuming that it concerns the driveway at your home, no one is allowed to park the car there. It is your driveway. Anyone who does this is making improper use of your land and is liable to trespassing. In addition, you are also entitled to have the car towed away and to recover the costs from the person concerned. Please note that there is a possible burden of proof, should it end up in court. Blocking a driveway is also not permitted. If you need further help and/or advice, you can always contact me.
