Legal assistance with temporary employment contract problems
Questioner
On June 10th I was told by the employment agency that I have worked for 70 weeks and that I still have 8 weeks to go through them. I would then have to be taken over in the 79th week at the company where I work. By the way, I have a zero-hour contract through the employment agency. On June 10th the supervisor confirmed to me by email that I will be taken over but they came back to it yesterday. She also indicated that she cannot remember giving me a commitment. (Well I got it confirmed by email so I have it in writing) The reason is that the company can no longer give me hours. (The company works with projects. The project I am currently working for gives a certain amount of hours each month. The company must then ensure that those hours are also worked. The company indicates that they now get 4000 hours and that will become 2000 hours. So fewer hours, so less work and because I had to get an extension, they indicated that this is the case and that they have no work for me) I have the idea that my company already knew that there would be a reduction in hours because it was previously indicated 'hey guys, it's been quiet on the project for a while and they want us to work fewer hours' so then people had to hand in hours by working less. After two weeks that was no longer necessary. This happened a few months ago. We had to do that here in the Netherlands but also the colleagues in Turkey who have set up the same project there and they were busy setting up this same project in Barcelona. My company had to see it coming that there would be less work for the people working on the project. And then they make a promise to me on 10-06 that I will be taken over and then 3 weeks before I should get an extension they come and tell me 'yes it's not going to happen'. Can someone tell me what I can do about this?Lawyer
If you do not agree with this decision, you can inform them of this in writing and request that you simply continue to work. However, you have a temporary employment contract and have various phases in it and if your contract expires and they indicate that they no longer have work for you, they can simply put you aside after termination. This does not mean that you have to agree with it and you can still make this known in writing. If you feel that there is work, you can still request the judge to give his judgment on it. If you would like further help and/or advice, you can always contact me.Take the next step
