Legal Advice for Orthodontic Problems

Questioner

Last year I had an orthodontist draw up an estimate because I wanted lingual braces as an adult. Based on the estimate I said yes to the treatment. Now it turned out with one of the first invoices that the estimate was incorrect and that I would spend a lot of extra money. They then stated in a signed letter that they would adhere to the established treatment and would not exceed the amount. Now I have reached the total amount (3200) and this would mean that the remaining treatment would be at their expense. In my opinion I am not even halfway (for example the estimate states that I need 18 consultations and I have now had 9). According to the orthodontist they are straight enough and this is the most achievable result. If he were to do even more to my teeth it would only become less beautiful. I then requested a second opinion from another practice. Coincidentally I had also been there before I got my braces in Zwolle because they also do lingual braces (in Apeldoorn). I live in Zwolle and am currently being treated by an ortho in Zwolle. They have not been doing specific lingual treatments for very long and that is why I first went to Apeldoorn. This ortho said that my teeth were even worse dentally and that a maxillofacial surgeon may have to be involved to repair the damage that had been done. He also said that the treatment was not yet ready, both aesthetically and dentally (I also have this on paper with a signature, albeit in jargon and a slightly nicer approach). I will soon be talking to my own ortho about this, but I actually want my money back and I also want to be able to recover the costs that I have spent with another ortho for further treatment from them. Is this possible? Because I actually no longer trust my own ortho and therefore do not want to continue my treatment there, but I do want my teeth to be better/more beautiful. And I think I have already spent more than enough money. Moreover, they promised me that my teeth would be nice and straight after the treatment (in other words, that was possible with my jawline and position of teeth). I would like to know what the possibilities are in this regard. thank you in advance

Lawyer

If you have suffered more damage, it is wise to hire a personal injury lawyer and put the current orthopedist in default and also hold him liable for the damages suffered. You can then also claim back the costs incurred + the additional costs and any emotional damage. There is a good personal injury specialist in Enschede who can assist you well in this.
