Wage garnishment and your rights - Legal Aid

Questioner

My wages have been garnished and €900 has been withheld without asking what my fixed costs are, etc. I called last Wednesday. I had to send all the papers and have not heard anything yet. Is that allowed? Can my employer do this without informing me? Because there was too little money left, I was unable to pay my prepaid energy bill in full. Now my contract has been terminated and I have to pay connection costs and 1 month's advance. Can I hold the bailiff liable for this?

Lawyer

The bailiff can garnish wages, which the employer is obliged to cooperate with. An attachment-free amount is taken into account so that you can continue to provide for your livelihood. This means that the bailiff must have made a calculation in advance. I notice that this was not done in your case. In that case, you can file a complaint with the bailiff in question about the method and hold him liable for the consequences. For more information, please contact me directly.
