Advice on Divorce and Prenuptial Agreements
Questioner
Dear Legal Aid Clinic, 2 years ago I brought my Turkish wife here. Lately things have been going so badly that I am on sick leave with stress, and can't/don't want to continue. Fortunately we don't have children, and I don't know if we are married with or without a prenuptial agreement. She also now indicates that she doesn't want anything at all after the divorce, which is why I want to sort everything out here first before she goes back because otherwise her mother will want to get everything out of it that is in it.Lawyer
You marry in full community of property, unless you opt for a prenuptial agreement and also draw up and register this before (or during) the marriage in the legally prescribed manner. Since you do not know this, I assume that you are married in community of property. You can record all aspects of the divorce in a divorce agreement and use it to submit the petition for divorce to the court. I advise you to engage a lawyer. If you are also registered as married in Turkey, divorce proceedings must also be followed there.Take the next step
