Liability for leaking insulated glass
Questioner
Leaking insulated window in owner-occupied home In May 2015 we sold our house. The house will be delivered in a few weeks. Between signing the purchase agreement and actual delivery, we discovered that a 15-20 year old insulated window was leaking (condensation between the sheets). Are we as sellers liable to have this window replaced? And are all costs for the selling party? Or is it sufficient to report it to the buying party? I have heard something about normal degradation of the house and also something about the fact that a buyer should not expect new for old. What about a leaking insulated window?Lawyer
As the selling party, you have the duty to provide information. However, they can demand that you replace the window or deduct the costs from the purchase price. However, I think it is wise to replace the window anyway.Take the next step
