Rights of apartment owners: use of parking space
Questioner
As the owner/resident of an apartment in a VvE, I have the right to use their parking space according to the Deed of Division of the adjacent VvE. In return, our VvE grants the right of way to the neighboring VvE because the path leading to the parking space runs for 2/3 over our land. Now our VvE has its own parking garage, which makes the right to use the parking space as an owner/resident somewhat redundant. My question is whether my visitors are allowed to use their parking space. In other words, is the right granted to the resident/owner alone (so the term member in its narrowest form) or is the right granted to the resident/owner including the normal social circle that goes with it?Lawyer
The right is granted to the owner of the apartment right and extends to the use of the parking space by the owner. Whether the parking space may be used strictly only by the owner will have to be apparent from the provisions in which the easements are described. If nothing is specified herein regarding the use of the parking space, then in my opinion the owner is also entitled to temporarily allow a third party (during a visit to you) to use the parking space. If there is a question of longer use, it can be regarded as rent, for which you need the permission of the VvE according to the division regulations.Take the next step
