We have a problem with our insurance company. my friend was driving on a priority road and wanted to turn left at a t-junction. Direction to left. Most left kept own side of the road. Then he is overtaken. Collision. Now the insurance company says that my friend has been held liable on the basis of Article 18rvv. They sent us this article but deliberately left out paragraph 3. Which clearly states that the car behind my friend must give way to the turning car. Unfortunately, we have the same insurance company as the other party. What should we do now?Lawyer
What you say about section 3 of article 18 RVV is indeed correct. This article states that, in deviation from the first two sections, drivers who are close behind a driver who has been pre-sorted to the left or right or who is driving in the extreme right or left lane of his section of the road and who has indicated his direction, must give way to that driver. I also wonder where the other party wanted to go. Overtaking just before a T-junction is not the wisest choice for the other party. You can certainly point out the above to the insurer.
