Advice on family matters: legal assistance after death
Questioner
after my father passed away my mother and I made a contract. She would pay me 50,000 € in installments. If she did not meet her payment obligations I would take further action. After she had paid me 18,000 € she refused to pay further. What do you advise me to do? with kind regards,Lawyer
In the family atmosphere, these are always unpleasant disputes. If the relationship with your mother is still good, I would of course advise you to have a conversation with her first. If a good conversation is no longer possible or does not yield any results, I would advise you the following. I advise you to summon her in writing to pay the outstanding installments within 14 days of the date of the invoice and to resume payments thereafter. If she fails to do so, you can terminate the agreement and claim the entire remaining amount in one go. Given the amount of the claim, you should seek legal assistance in the event of legal proceedings. I am happy to help you with this. In the extrajudicial phase, I perform my work on a 'no cure, no pay' basis, whereby I will do my utmost to recover the costs from your mother. If you have any questions or require legal assistance, please feel free to contact me without obligation.Take the next step
