Assistance with attachment of AOW and pension
Questioner
I am Dutch and living abroad I receive AOW and a pension from the Netherlands, or rather I received both benefits have been seized by a bailiff I now receive nothing at all and can therefore no longer provide for my own livelihood. If I am well informed, people who live in the Netherlands are entitled to a minimum benefit. Does this not apply if you live abroad? I can of course return to the Netherlands and apply for benefits there, but then I need an address or can I, as a "wandering person", also apply for benefits to provide for my livelihood? Thank you in advance for your responseLawyer
In the Netherlands, an attachment-free amount does indeed apply. For people who live abroad, this attachment-free amount unfortunately does not apply. You can ask the bailiff to keep a reasonable amount per month outside the attachment. You cannot force him to do so. If you live in the Netherlands, you are entitled to the attachment-free amount, even if you do not have a permanent place of residence or abode. However, you must then register somewhere as a homeless person and actually reside in that place or region. If you do not do this, this does not apply. As soon as you live in the Netherlands, part of the AOW and pension will be paid out again.Lawyer
If you can demonstrate the cost of living, you can request the subdistrict court in the Netherlands through a lawyer to allow you to keep a monthly amount.Take the next step
