Legal questions about property boundaries and windows
Questioner
Hello Last year we added a kitchen to our house I did the permit check for this and it turned out that it could be built without a permit. The extension borders directly on a plot of agricultural land and we have placed a permanent window in it. The land is leased, but now the owner suddenly appeared at the door with the comment that I am not allowed to place a window within 2 meters of the property boundary. I had looked this up in advance and still assume that this is permitted since it is agricultural land and not a yard. can someone tell me if this is allowed thank you in advanceLawyer
It is indeed true that no window may be placed within two meters of the property boundary that looks out onto the land of the neighbors. This is in connection with a possible violation of privacy. This does not matter what kind of property this is. However, the question is whether you are now violating the privacy of your neighbors. However, this does not seem to me to be the case. However, if this were to occur before a judge, it could go either way.Questioner
Dear sir. attached a section from article 1 that I found on the website: http://vergunningvrij.omgevingsvergunning.com/index.asp and in an article at the Council of State yard: a plot of land, whether or not built on, or part thereof, that is located directly adjacent to a main building and that is in fact designed to serve the use of that building and, insofar as a zoning plan or a management regulation applies, does not prohibit such design; In our case, the plot next to us does not have any building and is located in a rural area. it seems to me that in our case this 2 meters does not apply here greetingsLawyer
The law clearly states that there may be no windows from two meters from the property line unless the neighbors give permission. This should be recorded as evidence. A judge will look at the legal framework, the environment and the situation on site. And from this point it is also impossible to predict. I have attached a link for you that clearly describes what is and is not allowed. http://www.ekbouwadvies.nl/bouwen/burenrecht/vragen.aspTake the next step
