Questioner
My neighbours want to build a shed across the entire width of the garden. The garden is approx. 23 metres deep and 5 metres wide. An extension of approx. 2 metres across the entire width of 5 metres has already been built onto the house. They want to build the shed approx. 2 metres from the end of the garden. Shed approx. 5 metres wide and 5 metres long and a window on my side of the garden. Now I have a beautiful view of the fields and mills. I would like to know: 1. Are you allowed to just build this? 2. Does it still have to be built at a certain distance from the property line? 3. A window on my side is allowed. 4. What is the maximum height?Lawyer
To answer your question precisely I would need to know where you live. Via ruimtelijkeplannen.nl you can also request the applicable zoning plan and the building regulations / building possibilities that apply to your neighbours' plot. In general I can say that building up to the property line is almost never allowed without the permission of the other neighbours (except for extensions), but that usually a 'free zone' of 1 to 2 metres must be maintained. This depends on the provisions in the zoning plan. A window on the property line (or within two metres of it) with a view into your garden is not permitted under the neighbour law in the Civil Code.Lawyer
In addition to the answer above: Keep an eye on the municipal announcements. If a permit needs to be issued, it will be announced so that you can file an objection if necessary.Take the next step
