I would like to sell my garden as building land, so that I can sell a house with a garden and a piece of building land. How do you approach something like this, what permits do I need?Lawyer
You would be wise to first check in the zoning plan that applies to your location which zoning designation(s) currently apply to your location. If you want to be able to sell your land that is currently zoned 'garden' with the zoning designation 'building land / residential', then either the zoning plan will have to be adjusted or, for example, an environmental permit will have to be issued to allow the land to be used as building land instead of as a garden, in deviation from the zoning designation. Whether the municipality will want to cooperate in changing the zoning designation or granting the permit will depend on the specific circumstances of your situation. Assume that you will at least have to be able to provide good reasons why changing the zoning designation 'garden' to the zoning designation 'residential' is a 'good thing', whereby the emphasis should of course be on the importance of the environment and not on the possible 'own interest' that you might have in a zoning change.Take the next step
