Legal questions about employment contracts and compensation

Questioner

My employer is starting an emergency service that I will have to work 24/7 for approximately 20 days a year. According to him, my employment contract can be adjusted in the company's interests. Can I just do this or am I allowed to refuse it? The second point is that the compensation is very low in my opinion, namely €20 gross per day that you are available and may have to leave due to a breakdown. The hours that are worked outside normal working hours are compensated as overtime. What is a usual compensation for being on standby per day for 7 consecutive days.

It is indeed possible to adjust an employment contract. However, this cannot be done unilaterally. You must agree to this at all times. If you do not do this, the adjustment of the contract will have to be enforced through the court and your employer must have good reasons for this and must take your personal circumstances into account. If you do not agree, you or a lawyer must make this known to your employer in writing. As for the salary, it is impossible to say and depends on the sector and any applicable collective labor agreement. If there is a collective labor agreement, your employer must adhere to it and may not deviate from it.
