Assistance with legal questions about sharing annuities
Questioner
The court ordered me to share my annuity with my ex. He doesn't have to share anything because he has a pension statement. Now the other party requires me to transfer half of my annuity within five days, while this annuity will not be paid out until 2014. The order does not set a time limit. I have suggested to offset his credit with my credit (alimony), but the other party does not agree. I don't own a home and I don't have a job anymore (63 years old). So I can't take out a loan. The alimony will continue until the end of 2012. What should I do?Lawyer
For offsetting, mutual consent is required, which is therefore not possible without agreement. If the court ruling states unconditionally that you must pay a certain amount within a certain period, then you must comply with this. You may want to consider appealing the ruling.Take the next step
