Legal Assistance with Building Permits

In 2002 it turned out that the fence (located on the public road, backyard) that I had placed was too high. I should have applied for a building permit for that. The municipality would investigate whether or not the fence could be legalized. I have never heard anything about this until today. Now, 06/04/2012 I have received a letter stating that, tested against the new regulations from 2011, the fence may not be higher than 1 meter. This gives me an enormous view and I have lost all my privacy. Is it allowed to just test the same fence against the new regulations 10 years later?
