Reporting fraud: Free legal advice
Questioner
We have a company that sells a device with the associated pesticide. This is used in animal husbandry. For the pesticide that we sell for the application of this device, we are the owner of the NL registration. This registration took 3 years plus tens of thousands of file costs. Another company has copied the device. (this is legal) What is not legal is that he has copied our registration documents (he was once an agent). Equitrend and Horselife sell a pesticide with their device. They give our documents with that pesticide to the customer as belonging to the pesticide. Customers believe this. It is, in my opinion, pure fraud towards the customer. Falsity in writing towards us. The pesticide that they sell to the customer can be dangerous for the environment, humans and animals!! Because people do not know what kind of pesticide it actually is? How can I report it?Lawyer
I would advise you to contact the police station in your place of residence and make an appointment there to draw up a report. You may encounter unwillingness, in which case you can always appeal to article 163, section 5 in conjunction with 165 of the Code of Criminal Procedure, which states that the police are always obliged to record a report. Bring as much evidence as possible, so all papers, documents or witnesses that show that they are selling their pesticide with your papers, and possibly a chemical report that shows that the composition of their pesticide is different from yours. It is important that you indicate that you want to be kept informed of the progress of the criminal case. In that case, the Public Prosecution Service is obliged to inform you of decisions in this case. After filing a report, the police or the Public Prosecutor can decide whether to prosecute or dismiss the case. In the latter case, you can ask the Court of Appeal to order the Om to institute prosecution after all. Success!Take the next step
